Terms of Service
Effective November 2026
These terms apply whenever you use nextdaytitleexam.com or order a title examination from NextDay Title Exam. NextDay Title Exam is a service of Starlight Abstract LLC (“we,” “us”). “You” means the person placing the order and the company they order for. By placing an order or saving a card with us, you agree to these terms.
The short version
- We examine the title records you send us and deliver a written exam, usually by end of the next business day.
- Our exam is not title insurance, not a title search, and not legal advice. You and your underwriter make the insuring decisions.
- Prices are $75 for a residential exam and $125 for a commercial exam. Anything extra is quoted by email before we do it.
- Your card is charged only after your exam is delivered.
- Cancel before we start and you pay nothing. Cancel after we start and you pay half the base fee.
- If we make a mistake on the records you sent, we fix it at no charge. Our total liability for a file is limited to what you paid for it.
1. Our services
What we do. We review the title search package and documents you provide and prepare a written title examination report. A standard exam covers vesting, chain of title for the search period you provide, mortgages, liens, judgments, taxes and municipal charges shown in your materials, proposed Schedule B-I requirements and Schedule B-II exceptions, and curative notes.
What we don’t do unless you order it separately. A standard exam does not include running or updating searches, reviewing entity documents, leases, surveys or plans, reviewing whether a past foreclosure was properly carried out, obtaining payoff letters, or communicating with lenders, municipalities, courts or other parties. Where any of these is needed, we’ll tell you and quote it by email first.
Not title insurance. Our exam is a professional review prepared for your use in deciding whether and how to insure. It is not a title insurance policy, commitment, guarantee or warranty of title. Only a title insurer issues title insurance, and you and your underwriter remain responsible for all underwriting and insuring decisions, including the final commitment and policy.
Not legal advice. We do not provide legal services or legal opinions, and no attorney-client relationship is created by any order, communication or exam. If a file raises a legal question, consult your own counsel.
Only as good as the records. We examine the materials you provide. We are not responsible for documents that were not in your package, for errors or omissions in the search or the public records themselves, for matters that were not of record, or for anything recorded or filed after the effective date of your search.
Underwriter requirements. When you name an underwriter and give us its special requirements, bulletins or approvals, we apply them to the exam. We are not responsible for underwriter requirements you did not tell us about, and we don’t obtain underwriter approvals on your behalf.
Coverage. We examine files in most states. In some states, title must be certified by an attorney or a licensed person. We may decline any file we can’t properly examine, and you won’t be charged for a declined file.
2. Ordering
You can order through our website, by email to [email protected], or by phone. You agree that the information you give us is accurate and that you have the right to share the documents you send for the purpose of having them examined. An order is accepted when we confirm it by email. If your package is incomplete, we’ll tell you what’s missing, and the turnaround clock starts when we have what we need.
3. Turnaround
Standard. Complete files received by 2 PM Eastern on a business day are due by end of the next business day. Files received after 2 PM Eastern are due by end of the second business day.
Rush. Rush files received by noon Eastern on a business day are due by end of that same business day, if we accept the rush. The rush fee is quoted by email.
Business days are Monday through Friday, excluding U.S. federal holidays. Files received after the cutoff, or on a weekend or holiday, are treated as received the next business day.
If we’re running late, we’ll tell you as soon as we know. If we miss the due date for a reason within our control, you may cancel that file at no charge. Turnaround times are our commitment to you, but we are not liable for losses caused by a delay, such as a postponed closing.
4. Pricing and payment
Prices. A residential exam is $75 per file and a commercial exam is $125 per file. Rush handling, foreclosure review, entity or lease review, and other work outside a standard exam are quoted by email and charged only if you approve them. Agency volume rates are agreed in writing. We may change our prices for future orders by updating this website; the price that applies to a file is the one shown when you ordered it.
Card on file. We require a valid payment card for every order. Cards are saved and charged through our payment processor, Stripe. We never receive or store your full card number.
Authorization. By saving a card, you authorize Starlight Abstract LLC, doing business as NextDay Title Exam, to charge it for each exam you order at the posted price, plus any additional fees you approved in writing, including by email. We charge after the exam is delivered. Agency volume accounts may be charged once a month for that month’s files.
Declined cards. If a charge is declined, we’ll contact you, and you agree to provide another payment method within five business days. We may hold new orders until your account is current, and we may withhold delivery of a completed exam until payment is received.
Disputes. If you have a problem with a charge, contact us first at (908) 315-5615 or [email protected] and we’ll work it out. Filing a card dispute for an exam that was delivered as ordered may result in suspension of your account, and we may provide the order details and the delivered exam to the card issuer.
Taxes. Prices do not include any sales or similar taxes that may apply in your state.
5. Cancellations
- Before we start: cancel at no charge. If you cancel by phone or email before we’ve told you the file is in progress, you won’t be charged.
- After we start, before delivery: 50% of the base fee ($37.50 residential, $62.50 commercial). Any rush fee you approved is charged in full once rush work has begun.
- After delivery: the full fee applies.
- If we cancel or decline a file, or miss a due date for a reason within our control and you choose to cancel, there is no charge.
To cancel, call (908) 315-5615 or email [email protected] with your reference number. A cancellation is effective when we receive it.
6. Corrections and refunds
Questions. Follow-up questions about a delivered exam are included in the price.
Corrections. If you believe an exam contains an error based on the materials you sent us, tell us in writing within 30 days of delivery. If we agree we made an error, we’ll correct the exam promptly at no charge. If the corrected exam doesn’t resolve the problem, we’ll refund the fee you paid for that file.
Updated or new materials. Re-examining a file because of new documents, an updated search or a changed transaction is new work and may be charged as a new order.
7. Limits of liability
Our responsibility. We prepare every exam with reasonable care. Correcting the exam or refunding its fee, as described in section 6, is your sole remedy for an error in our work.
Cap. To the fullest extent the law allows, our total liability for any claim arising from a file, whatever the legal theory, is limited to the fees you paid us for that file.
No indirect losses. We are not liable for indirect, incidental, consequential, special or punitive damages, including lost profits, lost business, delayed or failed closings, title insurance claims or losses, or costs of curative work, even if we were told they were possible.
Who may rely on our exam. Each exam is prepared only for the client who ordered it, for use on that transaction. No buyer, seller, lender, insurer or other party may rely on it as against us, and you agree not to represent otherwise.
No other warranties. Except as stated in these terms, our services and this website are provided “as is,” without warranties of any kind, express or implied.
Indemnity. You agree to indemnify us against claims by third parties arising from your use of our exams, the materials you provided, or your breach of these terms, except to the extent a claim results from our own error within the limits above.
8. Your files and confidentiality
We use the documents and information you send only to prepare your exam, communicate with you, and keep business records. We keep them confidential, store them in a private, access-controlled account, and share them only with the people working on your file and the service providers described in our privacy policy. Files may contain nonpublic personal information about borrowers and owners, and we handle them with that in mind. You are responsible for having the right to share any personal information you send us.
We keep order records and files for as long as needed for our business and legal obligations. You can ask us to delete a file once it is no longer needed for those purposes.
9. Legal terms
Independent service. In examining your files we act as an independent service provider to you, not as your employee, agent or partner. Although Starlight Abstract LLC is also a title agency, an exam we prepare for you is not issued on behalf of any title insurer, and ordering one does not make us your title agent or create a commitment to insure.
Website use. Don’t misuse this website, including by uploading malicious files or trying to access orders or systems that aren’t yours.
Changes. We may update these terms by posting a new version here with a new effective date. The version in effect when you place an order applies to that order.
Governing law. These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Middlesex County, New Jersey, and you and we consent to their jurisdiction.
Whole agreement. These terms, together with any written volume agreement and the quotes we send you by email, are the entire agreement between us about our services. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it.
